How to Report
The University encourages students who become aware of an incident of Prohibited Conduct to immediately inform the University by making a report about the incident through the Just Report It form.
You may also report an incident of Prohibited Conduct by contacting the University's Title IX Coordinator or Deputy Title IX Coordinator at (434) 297-7988, email@example.com, or in person at the Title IX Office located in O'Neil Hall, 445 Rugby Rd., Room 037, Charlottesville, VA 22903. Certain University employees are "Confidential Employees." Under the University's Reporting Policy, a "Confidential Employee" is (1) Any University employee who is a licensed medical, clinical, or mental-health professional (e.g., physicians, nurses, phsicians' assistants, psychologists, psychiatrists, professional counselors, and social workers, and those performing services under their supervision), when acting in that professional role in the provision of services to a patient who is a University student ("health care providers"), and (2) any University employee providing administrative, operational, and/or related support for such health care providers in the performance of such services. All other University employees are "Responsible Employees," which are explained in detail below.
If you wish to disclose information only to a Confidential Employee, you should understand that, except in limited circumstances (e.g., (1) you give written consent to disclose the information; (2) there is a concern that an individual will cause serious physical harm to self or others; or (3) the information concerns conduct involving suspected abuse or neglect of a minor under the age of 18), the University will be unable to use the information to conduct an investigation into the alleged incident or to pursue disciplinary action.
If you initially seek the assistance of a Confidential Employee, you always have the right to report an incident of Prohibited Conduct to the University and/or local law enforcement. In such cases, if you communicate to a Confidential Employee that you wish to make a report, the Confidential Employee should support your decision and direct you to the Just Report It form, the Title IX Coordinator, or the Deputy Title IX Coordinator.
You may obtain information from Confidential Employees about how to access health or mental health services, including victim advocacy services. If you wish to request remedial or protective measures (such as a no contact directive, academic modifications and support, or modifications to University residence, employment, and/or parking arrangements), you will be directed to the Office of the Dean of Students ("ODOS"). ODOS employees are not Confidential Employees and thus will disclose to the Title IX Coordinator any information you share with them about the Prohibited Conduct. However, you may receive assistance, support, and appropriate remedial measures regardless of whether you decide to pursue or participate in a complaint or investigation under the Title IX Policy or through law enforcement.
Information that you disclose about Prohibited Conduct to certain University employees, called "Responsible Employees," will be reported to the Title IX Coordinator. A "Responsible Employee" is any University employee who is not a Confidential Employee. Responsible Employees are required to report all relevant details about an incident of alleged Prohibited Conduct--including the names of the reporting student, the parties, and any witnesses, and any other relevant information (e.g., the date, time, and specific location of the alleged incident)--to the University's Title IX Coordinator through the Just Report It form. The Title IX Coordinator or a representative from ODOS, such as the Dean on Call, will provide you with information about your resources and options, offer appropriate and available remedial and protective measures, and take appropriate action to resolve the reported incident as promptly and equitably as possible. To the extent possible, information that you disclose to a Responsible Employee will be shared only with a limited circle of other University employees who "need to know" in order to assist in the assessment, investigaiton, and resolution of the reported incident. If you are unsure about whether a particular University employee is a Responsible Employee, you should ask before disclosing any information you wish to remain confidential.
Some examples of Responsible Employees include, but are not limited to:
- Resident Assistants
- Teaching/Graduate Assistants
- Deans on Call
- Faculty Members
If you wish to tell a Responsible Employee what happened but also to maintain confidentiality (i.e., request that the information be maintained confidentially, that no investigation occur, and/or that no disciplinary action be taken), you may make such a request when reporting. Your preferences are important to the University. Whenever possible, the University must balance such a request with its obligation to ensure that you, and the University community, are safe.
