What Resources Are Available?
You have options for sharing concerns with confidential UVA resources or a non-confidential resource like our office, which offers options to resolve your concerns informally or formally. We have provided information below to help you understand which UVA resources have Confidential Employees who do not have reporting obligations and what happens when you share information with a non-confidential employee. Non-confidential UVA employees are called Responsible Employees.
A Responsible Employee is any UVA employee who is not a Confidential Employee. This includes faculty members, teaching assistants, resident advisors, academic coaches, employees in Student Affairs, University Police Department personnel.
A Responsible Employee is required to report to EOCR all relevant details you disclose about an incident of alleged discrimination, harassment, or retaliation, including the names and all other information that personally identifies you, the parties, any witnesses, and any other relevant information (e.g., the date, time, and specific location of the alleged incident).
Responsible Employees are required to report all disclosures of discrimination, harassment, or retaliation, including those made in the context of Public Awareness Events (e.g. candlelight vigils, “survivor speak outs,” or other public forums held on property owned or controlled by the University or through online platforms sponsored by the University; collectively “Public Awareness Events”), or when the disclosure in made in the course of academic coursework, including classroom discussion, papers, or other assignments.
Students can seek non-confidential support through the UVA Care and Support Services team.
A Confidential Employee is:
- any UVA Employee who is a licensed medical, clinical, or mental-health professional (e.g., physicians, nurses, physicians’ assistants, psychologists, psychiatrists, professional counselors and social workers, athletic trainers, and those performing services under their supervision), when acting in that professional role in the provision of services to a patient (“health care providers”);
- any UVA Employee when performing administrative, operational, and/or related support for such health care providers;
- any UVA employee who is an Athletic Trainer working under the supervision of a licensed medical or healthcare professional when performing the duties of that professional role; and
- the UVA Ombuds when acting in that professional role.
If you speak to a Confidential employee about potential discrimination, harassment, or retaliation, that employee will not share that information with our without your consent.
Confidential Employees are required to share: (1) their status as a Confidential Employee; (2) how you may contact EOCR and submit a report; and (3) that EOCR may initiate resolution under the DHR Complaint Procedures.
Please note that information disclosed to Confidential Employees will not be shared with EOCR or anyone else and, therefore, UVA will not be able to use such information to provide supportive measures, offer resolution, or to pursue disciplinary action against the Respondent.
If you decide to make a report to UVA and/or local law enforcement, the Confidential Employee can assist you or direct you to the appropriate UVA resources for assistance with such filing or further reporting.
Supportive measures are available without filing a complaint. Supportive measures can include no-contact directives, academic, housing, or parking modifications, referrals or facilitation of access to on- or off Grounds health care providers, or changes to work schedules.
